So Does the Upcoming Nominee Deserve An Up or Down Vote...

        Isn't that just the most insane thing? I'm continually amazed at the way Conservatives want to control women and think they have the right to do so. Because that's what this fundamentally is - a way to control the lives of 50% of the population.

            Agreed - the comment about women was simply to show how easily 50% of the population can be directly affected by a bad law.

    • Nope, Roe v. Wade (and Casey as well) is still safe. There are currently 5 votes for it on the court: Kennedy, Souter, Bryer, Ginsberg, and Stevens. Also it is unknown how Roberts is likely to vote. While he doesn't support abortion, he seems very hesitant to overturn prior decisions, especially ones that have been repeatedly re-affirmed.

          He was one of the 5 votes that upheld Casey [findlaw.com] as well as writing the court opinion along with O'Connor and Souter. If anything he has gotten a bit more liberal since then. Some think that with O'Connor gone he may move to her position ideologicly on the court.

          Then again he did side with Rehnquist, White, and Scalia in Webster [findlaw.com], so I suppose you are correct in not fully trusting him on the central question of Roe [findlaw.com]. Then again he does seem even more disin

            Yet I remain steadfast in my belief that the right to reproductive choice is entitled to the full protection afforded by this Court before Webster. And I fear for the darkness as four Justices anxiously await the single vote necessary to extinguish the light.

            That quotation sends chills down my spine.
