Journal OMNIpotusCOM's Journal: America is broken, this is how to fix it pt.1 4

Lawsuits. Frivolous lawsuits are the bane of the intelligent. Getting rid of the "bad" lawsuits would solve more problems than changing the president, senate, house, and every other level of government. Certain lawyers would get less money, some would be completely out of a job, we wouldn't have to have "Caution: Coffee served very hot" labels on everything, and it would save states, companies and the government untold millions.

I've said it before and I'll say it again, if you get a finger in your Burger King meal, you deserve some money because it's pretty obvious someone was negligent (it's SOMEONE'S finger... right?); if you poke your eye out by drinking your Starbuck's coffee that you left the coffee stirrer in, you're just retarded and should probably die quietly. If you wreck your car while you are fleeing the cops, you shouldn't be able to sue (the cops should be able to end the chase before it gets to that point anyway, but that's another topic); if you crash into a soccer mom in her minivan while avoiding the cops, you shouldn't be allowed to live.

The problem is who is to decide what a bad lawsuit is? That's the part I haven't figured out yet, and I'm not sure there is a good answer. At this point though, I'd rather abolish all lawsuits and hurt a few people rather than let the innumerable stupid ones through.

...more to come...

  • The simple answer is to place a hard limit on punitive damages, and a harder limit on what percentage the lawyers can collect.

Nasty lawsuits are also one of the primary reasons health care is so hideously expensive in this country. Because of a litigious populace coupled with zealous lawyers, malpractice premiums are insanely high.

I'm not saying you shouldn't be able to seek compensation when you are wronged, but there should be reasonable limits on how much you can demand just to make 'em squirm.
    • Nicely done. I think part 3 is insurance (in all forms), so look forward to that one =)
      • I was actually meaning to incorporate that into my post but I wasn't quite sure how to work it in. The insurance problem is real and growing. There's a feedback loop occurring right now:

        1. Insured charges EVERYTHING through medical insurance
        1. Insurance company pays whatever doctors bill
        2. Insured doesn't contest charges because premiums are paid through employer
        3. Insurance rates go up to cover excessive use by insured
        4. Insured never receives the negative feedback of a higher bill, and so continues bac
        • And this whole time I was just going to dwell on the fact that you can't live without certain insurances (medical, life) and others are mandated for seemingly no reason (car, for instance, in Iowa). I got hit by a guy who didn't even have a valid driver's license, let alone any insurance, and I didn't get a new car out of the deal. He got a ticket. Exactly the same thing that would happen to me if I were pulled over for any reason and couldn't prove that I had insurance. Seeing as how I do believe in th
