There is a provision its just not enforced. Whenever someone files a false DMCA claim they are guilty of perjury (which carreis a 5 year jail term). So when Viacom went after YouTubers who were covered by the fair use provisions, Viacom committed perjury, but nobody pressed charges against Viacom. If people used MPAA and RIAA content that were strictly under fair use (and lets face it, they do it all the time) somebody needs to charge them, not sue (as they drag it out) but proceed in criminal charges (which legal work is done by the prosecutor) against these organisations. That way you could see Dodd go to jail.

So what law are they violating? I am talking about China not the US. A Chinese company does not have to answer squat to Apple nor the US legal system. They could make a doll with a penis on the head of Obama and the US Government couldn't touch them. Selling these dolls in the US is another matter (the Steve Jobs ones), but those that want them could simply import directly from China.

You have always been able to install unofficial apps on Android. The incentive to root your phone (not sure about tablets) is with alot of handset makers, they are painfully slow to provide updates for ROM's phones if they provide them at all.

HTC is a big culprit: their Gingerbread update took forever and only the Desire/Z/HD & Incredible got the upgrade at all.

We got around the rsyslog issues, had to change our build scripts from scratch but we got there.

Im just glad upstart's init support isn't broken considering its a one hit wonder and already has been replaced by systemd in Fedora

To be fair, malware started appearing on Mac after their move to Intel from PowerPC. The Mac benifited from 2 types of obscurity before the switch. Not only were Mac's not widely used back then, the PPC arch was not widely used either.

This is going to be a disaster. Look there is a vast difference in styles between British and American shows that just don't cross over very well. Im not saying American TV is bad (reality TV is very bad but thats a worldwide problem) but whenever the Americans try to adopt another countries show it loses what made it appealing in the first place.

I remember the horrible mess that was the US version of The Office, as well as the Australian show Kath & Kim.

I remember Hollywood wanted to mess with Red Dwarf, replace The Cat with a female, which alone would have ruined it. What?

Please America, you do you're own thing well and other countries do their thing well. When you try to "Americanize" an overseas franchise you kill the charm that made it good in the first place.

YouTube Censorship again

renegadesx (977007) writes "The creationist ministry Creation Science Evangelism has been filing false DMCA claims against certain YouTube members in what appears to be an attempt to silence all critics.

Creation Science Evangelism is the ministry started by Kent Hovind, who is currently serving a 10 year sentence for tax evasion and is now day to day operations are run by Eric Hovind.

Recently YouTube user "RabidApe" was suspended after multiple DMCA claims had been filed against his videos. Recently the Rational Response Squad tried to send messages and email YouTube notifying them on this matter and as a result have too had their account suspended.

It should be noted that Kent Hovind states many times in his material that his ministry do not copyright their material, essentially making all their content public domain. Also it should be noted if there was any copyrighted content, RabidApe and the Rational Response Squad used the material under "Fair use" for purposes of satire.

Their website has since made a recent change to their website stating their material is copyrighted effective January 2005. However they do not have any registered copyrights making these claims false.

YouTube has yet to release a statement and one is not likely. Rational Response Squad is currently considering legal action against Creation Science Evangelism as the number of false DMCA claims filed do class as a felony charge.
